One of the most immediate and serious consequences of a 209A order is its effect on firearms. Under G.L. c. 209A § 3B, a court issuing an abuse prevention order can order the defendant to surrender firearms and licenses — and this often happens right away.
What § 3B requires
When a § 3B provision is in the order, the defendant must surrender all firearms and ammunition in their control, ownership, or possession, along with any License to Carry firearms and any Firearm Identification (FID) card. The surrender requirement can attach to an ex parte order at the outset, before the 10-day hearing.
Why you have to act immediately — and carefully
Failing to surrender as ordered is itself a serious problem, and continued possession can expose you to criminal liability. But how you surrender matters too. Do not hand your firearms to a friend or relative or make an informal storage arrangement — that can create its own legal violation. The safe path is to surrender to law enforcement or a licensed dealer as the order and local procedure require, and to keep documentation of exactly what you surrendered and when.

What happens after the hearing
If the order is not extended at the 10-day hearing, ask the court and your attorney about the process for the return of your property and licenses. If it is extended, the firearms restrictions generally continue for the life of the order. Either way, do not retrieve or acquire firearms while any restriction is in effect.
